Judge Denies Part of Teen's Lawsuit in Molestation Case

A second ruling is expected this week in girl's suit against the county and a former Sheriff's deputy who pleaded guilty to molesting her in 2011.

A judge on June 3 threw out one part of a lawsuit against a Los Angeles County sheriff's deputy and the county in which a girl alleges the deputy sexually abused her.

The complaint was brought Dec. 12 in Los Angeles Superior Court and involves the actions of Deputy Kenneth Alexander, who was sentenced in September to 90 days in jail and five years probation. The 46-year-old pleaded no contest Aug. 10 to one count of oral copulation of a person under 18, according to Deputy District Attorney Andrea Thompson.

The girl, now 17, is identified in the suit as "Jane Doe.''

Ruling on a defense motion, Judge Josh Fredricks dismissed the teen's negligent infliction of emotional distress claim, but said there were enough details in the suit to support the allegations of personal injury and intentional infliction of emotional distress.

He said he wanted to ponder whether her lawyers need to shore up her allegation that her constitutional rights were violated by a policy or practice of the county or the Sheriff's Department. He said he would rule in about a week.

The suit also alleges negligent supervision and retention.

Alexander, who was assigned at the time to the sheriff's Marina del Rey station, responded to two calls at the girl's home in December 2010, according to the suit.

He gave the girl his business card and cell number both times and told her during the second visit that "he really liked her" and to "call him on his cell number if she had any problems,'' according to the suit.

The two began having phone conversations, the majority initiated by Alexander, that gradually grew to be "more sexual in nature," the suit states.

In January 2011, Alexander persuaded the girl to come to his home, where he told her about the first time he had shot someone and also said his partner was lazy, the suit states. He later asked her if he could take photos of her unclothed, but she refused, according to the suit.

Although the girl was "shaking and scared,'' Alexander took her pants off, performed oral sex on her and then had intercourse with her, according to the suit.

Alexander called the girl a month later and she agreed to meet with him again, at which time he induced her to perform oral sex on him, the suit states.

Alexander was placed on leave with pay in September 2011, then was placed on leave without pay when he was charged two months later.

The girl's attorneys said after the June 3 hearing that Alexander was later fired based on the girl's allegations.
